Dear Colleagues

I hope you all have had a rest during the Long Vacation. I want to again thank you all for your support and cooperation during the year. I wish to advise you of a few matters:

Callover of Civil cases for Clonmel commencing 13th October 2020.

This callover will be held in Clonmel Courthouse at 11.00am on Monday 14th September 2020. If both parties have agreed to adjourn the matter to the next callover, then they should email the office (clonmelcourtoffice@courts.ie) confirming same and there will be no need for the parties to attend at the callover. If the parties agree to seek a hearing date, then they should email the office (clonmelcourtoffice@courts.ie) confirming the total number of persons who will be attending (including parties, witnesses, solicitors and counsel) and confirming the estimated duration of the hearing. Again where i receive such an email, I will give the matter a hearing date and again there will be no need for the parties to attend at the callover. I would ask practitioners to consider using an agent in Clonmel to minimise the number of persons attending the callover.

Callover of Family Law cases for Clonmel commencing 27th October 2020

This callover will be held in Clonmel Courthouse at 12.00 noon on Monday 14th September 2020. If both parties have agreed to adjourn the matter to the next callover, then they should email the office (clonmelcourtoffice@courts.ie) confirming same and there will be no need for the parties to attend at the callover. If the parties agree to seek a hearing date, then they should email the office (clonmelcourtoffice@courts.ie) confirming the total number of persons who will be attending (including parties, witnesses, solicitors and counsel) and confirming the estimated duration of the hearing. Again where I receive such an email, I will give the matter a hearing date and again there will be no need for the parties to attend at the callover. Possession cases 
As you are aware, all possession matters have been adjourned since the spring in accordance with the moratorium which has now expired. I will be re-listing all possession matters currently adjourned to one of the following dates : Monday 2nd November 2020 at 2pm in Nenagh; Monday 9th November 2020 at 2pm in Clonmel; Monday 16th November 2020 at 2pm in Nenagh; Monday 23rd November 2020 at 2pm in Clonmel. These lists will be published in due course on www.courts.ie
Where the parties are seeking to strike a possession matter out or to have it adjourned on consent (whether for a specific period or generally with liberty to re-enter), I direct that the parties email me at jamesseymour@courts.ie with the details of their agreement and I will make the appropriate order without the need for either of the parties to attend at court.

Applications for appointment of a care representative or for a marriage exemption

Applicants and/or their legal representatives making either of these applications to me are not required to attend at court. They should lodge all the required documentation with my office and where the application and the proofs are in order, I will make the appropriate order without the need for the parties to attend at court.

Civil and Family Law Motions, Case progressions and taxationsWhere the parties have agreed either an adjournment or terms on foot of a motion or case progression, the parties should email me directly (jamesseymour@courts.ie) setting out their agreement and I will make the appropriate order without the need for the parties to attend at court. 

I also wish to remind all practitioners that taxation hearings and case progressions hearings can be heard via Zoom where the parties agree to same. If you wish to have a remote hearing, please email me directly.
