Exemption for special event or area application

What this application does

This application allows for the sale of alcohol in one area or district, without the need for a special exemption order. All pubs in the district can avail of the area exemption.

A number of dates (maximum six days) can be included in each application. If the event is for more than six days a second licence is required. The maximum term of any event is twelve days. No more than six applications can be made in respect of the same area in one year.

It is often used for Christmas festivals as well as other long weekends. The application may for example include the weekends in December with a variety of other dates to apply to sell alcohol and later opening hours during the Christmas markets.

The majority of licence holders within the district must consent to the application.

When an exemption for a special event or area is in place, you do not need to apply for special exemption orders.

You cannot apply for an exemption for a special event or area in the Dublin Metropolitan District.

How much this application costs

There is a fee of €750 per application.

How to apply

1. Complete your application

If you are a legal practitioner and have an account in CSOL, you can complete the application in CSOL. Alternatively, you can complete Form 73.1 manually.

2. Serve the notice parties

You must notify or serve the relevant notice parties for your application. If the application is submitted in CSOL, the notice parties are automatically notified. Alternatively, you can serve the notice manually. Please see our serving and proof of service page for more information.

For this application, the notice parties are:

  • An Garda Síochána must be notified at least seven days prior to the court date.
  • The public must be notified via a local or daily newspaper advertisement at least seven days prior to the court date.
  • The HSE must be notified at least one month prior to the court date.

3. Submit your application

Your application must be lodged at least four days prior to the court date. Applications for exemption orders for premises located outside of Dublin can be made during any District Court sitting in the district in which the application is being made.

4. Provide proofs to the court office

You must provide the required supporting documentation or "proofs" to the court office. This must be done manually as there is currently no option to upload the proofs listed below via CSOL.

What proofs are required

  1. Original notice of application with relevant stamp duty.
  2. Statutory declaration of service (where application is served manually).
  3. Copy of the original newspaper showing advertisement outlined in red border.
  4. Written approval of a majority of the licence holders in the area confirming that they consent to the application. To facilitate this a list of the licence holders in the area can be obtained from the court clerk. This form is used to indicate their consent.
