ResultThe respondent contested his surrender on the basis that:- (1) Correspondence did not exist between the offences in relation to which his surrender was sought and offences in this jurisdiction; and (2) His fundamental rights would not be respected if he were surrendered, particularly his right not to be subjected to inhuman or degrading treatment and his right to a private and family life. The Judge accepted the second of these points and refused to surrender the respondent to Moldova.
