Dublin Metropolitan District Court for Annual Licensing 2017

Dublin District Annual Licensing Court will be held in court No. 23, Ground Floor, Áras Uí Dhálaigh, Inns Quay, Dublin 7.

 

Note: For the efficient running of the annual licensing court, we would ask that all applications be lodged during the month of August, but not later than Friday 1st September 2017 at 12.30 p.m.

Use the application forms which have been prepared for the Dublin Metropolitan District Licensing Court.
The relevant notice parties are listed at the end of the application forms.

General requirements for all applications:

» Ensure that all documents are lodged together.

» Applications will not be listed on the annual licensing date unless all documents are lodged with the application.

» Insert your reference number from last year’s Annual Licensing Court on the top right corner of your application. Reference numbers can also be found in the index of registers in our office.

» Include on the application the name and full address of the solicitor/applicant.

» Provide a copy of your notice of application for court receipt, to retain for your files.

» State on the application form the type of intoxicating liquor licence attached to the premises.

» In relation to all new applications and all club and dance applications where the applicant is a company the application must be accompanied by:

  • a Certificate of Incorporation,

  • the extract from the Memorandum and Articles of Association showing the objects clause
    and
  • an up-to-date company printout showing the names and addresses of the current directors
    and
  • an ordinary resolution authorising a director to make the application on behalf of the company.
Note:

In relation to renewals, the applicant (if incorporated) must produce an Auditors Certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of the Companies Act, 2014.

In regard to Liquor Licensing Objections, a search may need to be carried out to establish the current licence holder of the premises.

You may be required to lodge further documents particular to your application.

Thursday 28th September at 10.30 a.m. - Confirmations and Certificates of Transfer

  1. Notice of application stamped with €150.00 per licence application. (Spirit €150 Beer €150 and Wine €150 total €450)

  2. Statutory declaration of service on all notice parties.

  3. Original newspaper advertisement, published at least 21 days before the court date (relevant page only showing date of publication).

  4. Relevant company documents (if applicable). Memorandum and Articles of Association showing the objects clause or constitution and an up to date company printout showing the names and addresses of the current directors and an ordinary resolution under seal authorising director/s to make the application on behalf of the company.

  5. Notice of application to include the description of the type of intoxicating liquor licence attached to the premises and name previous licensee.

  6. Certified copy of stamped deed of title or lease is required.
    The applicant (if incorporated) must produce an auditors certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of the Companies Act, 2014 if applicable.

Thursday 28th September at 10.30 a.m. - objections

  1. Objection forms can be obtained from the licensing office and this site - see link above. A copy of this form must be served on the licensee of the premises at least 21 clear days before the date of the annual licensing court.

  2. The original document should be lodged in the Licensing Office together with declaration of service on the licensee, by 1st September 2017.

  3. Stamp duty of €35.00 is required on original document for court.

  4. Notice of application to include the description of the type of intoxicating liquor licence attached to the premises and name of the current licence holder. 

 

Friday 29th September at 10.30 a.m. - general exemptions

  1. Notice of application stamped with €150.00

  2. Statutory declaration of service on all notice parties

 

Friday 29th September at 10.30 a.m. - clubs

  1. Notice of application stamped with €655.00

  2. Statutory declaration of service on all notice parties

  3. One month’s notice in writing to the fire authority

  4. Original newspaper advertisement (relevant page only showing date of publication), published at least 21 days before the court date

  5. Two up to date copies of the club rules

  6. The statutory certificate signed by 2 peace commissioners

  7. List of members of the club (large membership lists can be supplied on CD)

  8. List of names and addresses of committee, and their titles

  9. Where the applicant is a company the application must be accompanied by a Certificate of Incorporation, the extract from the Memorandum and Articles of Association showing the objects clause or constitution and an up to date company printout showing the names and addresses of the current director/s and an ordinary resolution under seal authorising a director/s to make the application on behalf of the company

    Note: in relation to renewals the applicant (if incorporated) must produce an auditors certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of  the Companies Act 2014, if applicable.

 

Tuesday 3rd October at 10.30 a.m. - restaurants

  1. Notice of Application stamped with €150.00

  2. Statutory declaration of service on all notice parties

  3. Notice of application to include a description of the intoxicating liquor licence attached to the premises

  4. Where a new applicant is making the application, a set of plans/planning permission/architects certificate of compliance are required to be lodged with the document
    - Disability access certificate where applicable
    - HSE food hygiene certificate where available

  5. Relevant company documents (new applications only). Memorandum and Articles of Association showing the objects clause or constitution and an up to date company printout showing the names and addresses of the current directors and an ordinary resolution under seal authorising director/s to make the application on behalf of the company.

    Note: in relation to renewals the applicant (if incorporated) must produce an auditors certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of  the Companies Act 2014, if applicable.

  6. Where an application for a Restaurant Certificate pursuant to section 12 of the Intoxicating Liquor Act 1927 was granted in the Circuit Court in the last 12 months, supply a copy of the Circuit Court Certificate or a letter stating when the application was granted in the Circuit Court.

 

 Tuesday 3rd October at 2.00 p.m. - music and singing

  1. Notice of application stamped with €150.00

  2. Statutory declaration of service on all notice parties to include the fire authority

  3. Notice of application to include a description of the type of intoxicating liquor licence attached to the premises (if applicable)

  4. Relevant company documents (new applications only). Memorandum and Articles of Association showing the objects clause and an up to date company printout showing the names and addresses of the current directors and an ordinary resolution authorising director/s to make the application on behalf of the company.

    Note: in relation to renewals the applicant (if incorporated) must produce an auditors certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of  the Companies Act 2014, if applicable.

 

Thursday 5th October at 10.30 a.m. - dance

  1. Notice of application stamped with €490.00

  2. Statutory declaration of service on all notice parties

  3. Original newspaper advertisement (relevant page only showing date of publication)

  4. Certified copy of a current policy of Public Liability Insurance in relation to the premises not a letter from a broker but the insurer, (copy of relevant pages from the policy document, not entire document)

  5. Where the applicant is a company the application must be accompanied by a Certificate of Incorporation, the extract from the Memorandum and Articles of Association showing the objects clause or constitution and an up to date company printout showing the names and addresses of the current director/s and an ordinary resolution authorising a director/s to make the application on behalf of the company

  6. * An up to date certificate from a fire consultant or architect that the premises comply with the Building Control Act 1990 in relation to fire safety or if the building pre-dates the Building Control Act that the premises complies with the Building Regulations (part B Fire) 1997. That is, that the building is fire safe.

    'Fire Consultant' means a chartered engineer with experience in fire safety engineering and fire safety management.

    'Architect' means a person qualified to Certify Compliance with the Building Regulations for conveyanceing purposes.

  7. * The fire consultant or architect to confirm that there is CCTV attaching to the premises, that the said CCTV is in working order and confirmation from the applicant that the gardaí will have free access to the said CCTV

  8. * If there is security on the premises, within the meaning of section 2(1) of the Private Security Services Act 2004, an up to date copy of their licence shall be produced. If there is no security same to be confirmed in writing by the applicant. If there have been no changes since last year, same to be confirmed in writing by an authorised person.

  9. Notice of application to include a description of the type of intoxicating liquor licence attached to the premises

* Copies of document 6, 7 and 8 to be served on the gardaí.

N.B.

All documents to be lodged in advance of annual licensing.

Any premises which do not produce the relevant documentation at annual licensing shall not be entitled to apply for special exemptions thereafter.

Where special exemptions are not being applied for, please confirm in covering letter.

In relation to renewals the applicant (if incorporated) must produce an auditors certificate confirming up to date compliance with all filing and tax requirements pursuant to the provisions of  the Companies Act 2014, if applicable.
