The Probate Office is governed by the following legislation and Rules of the Superior Courts.

• The Succession Act, 1965 (which came into operation on 1/1/1967)
• The Administration of Estates Act, 1959 (which applies to deaths between 1/6/1959 and 31/12/1966)
• The Adoption Act, 1952
• The Status of Children Act, 1987 (Part V) (which applies to all wills made after and deaths intestate after 14/6/1988)
• The Legitimacy Act, 1931(which applies to deaths between 19/5/1931 and 14/6/1988)
• The Family Law (Miscellaneous Provisions) Act, 1997
• The Rules of the Superior Courts 1986 - Orders 79 and 80 
• Supreme Court, Court of Appeal and High Court (Fees) Order
