Courts - Martial Appeal Court

The Courts-Martial Appeal Court hears appeals by persons convicted by court-martial. The appeal is determined on a record of the proceedings at the court-martial with power to hear new or additional evidence or to refer any matter for report to the president or the judge advocate of the court-martial. If the appeal is against the finding and the sentence, the court may affirm or reverse the finding in whole or in part, or order a new trial or vary the sentence. If the appeal is limited to either finding or sentence, the court is confined to dealing with the matter which is the subject of the appeal. The court also has power to review a finding or sentence (which was the subject of a previous appeal) where new evidence shows that there has been a miscarriage of justice. The decision of the Courts-Martial Appeal Court is final unless the court or the Attorney General certifies that the decision involves a point of law of exceptional public importance and that it is desirable in the public interest that an appeal be taken to the Supreme Court.
